Reports of Trade Mark Cases for CIPA - September 2018

This month we report on the Court of Justice decision regarding stay of infringement proceedings pending the outcome of a counterclaim for invalidity in Hansruedi Raimund v Michaela Aigner. We also look at the Court of Justice's final decision in the Louboutin case, which provided a definite answer on the registrability of a trade mark for colour when applied to the shape of a product (Christian Louboutin, Christian Louboutin SAS v Van Haren Schoenen BV).
