Reports of Trade Mark Cases for CIPA April 2022

This month, we report on the High Court’s judgment in easyGroup Ltd & Ors v Easyway SBH & Mr Stephane-Michael Roche (Mr Douglas Campbell QC; [2021] EWHC 2007 (IPEC); 22 July 2021) on whether a travel company based in St Barts targeted the UK for the purposes of a trade mark infringement and passing off claim. We also report the High Court’s decision in ABP Technology Ltd v Voyetra Turtle Beach, Inc. & Turtle Beach Europe Ltd* (Miles J; [2021] EWHC 3096 (Ch); 19 November 2021) regarding the acquisition of an earlier registration to use as a sword and shield in infringement proceedings.
