Reports of Trade Mark Cases for CIPA January 2021

In this month's report, we look at the CJ’s decision in Ferrari SpA v DU (CJ; C-720/18 & C-721/18) where the court explored the principles relating to genuine use. We also report on the GC’s decision in Ace of Spades Holdings LLC v EUIPO (T-620/19 – T-622/19) which reiterated the importance of considering a mark as a whole in a global assessment, and we review the GC’s decision in Forex Bank AB v EUIPO; Coino UK Ltd (T-26/20).
