We report on the Court of Appeal’s judgment in Montres Breguet v Samsung, which determined whether Samsung was liable for infringement based on third party watch face apps downloadable from Samsung’s Galaxy App Store. We also report on the Court of Appeal’s judgment in Quantum Advisory v Quantum Actuarial, which held that the ownership of a trade mark registration could be rectified under equitable principles. We also report on a judgment of the High Court which determined a preliminary issue of which characteristics of the parties’ products were being compared in comparative advertisements.
