On January 19, 2022, the Protocol on the Provisional Application of the Unified Patent Court Agreement entered into force. The final preparations for the UPC will now begin with the start of the Provisional Application Phase!

After Austria deposited its instrument of ratification to the Council of the European Union on January 18, 2022, the period of provisional application of the UPC Agreement now starts. During this period of provisional application, all final preparations for the introduction of the UPC will take place, such as the selection of judges and the adoption of secondary legislation. Following this preparatory phase, it is expected that the UPC will start in the second half of 2022.
