In this month's report, we look at the relevance of disclaimers when assessing likelihood of confusion in Patent- och registreringsverket v Mats Hansson (Case C-705/17). We also look at criminal sanctions for the unauthorised use of a registered trade mark under Section 92(1) of the Trade Marks Act in R v James Clements ([2019] EWCA Crim 2253)
