About Me

Working as a partner in our Regulatory and Administrative Practice Group, I mainly advise clients in the healthcare, transport and security and defence sectors, where my everyday practice centres around public regulatory, social, health and European law issues.

Advising clients from the private and public sectors on matters of public regulatory law, my particular experience is largely based around three industry sectors: healthcare, transport and security and defence.

In the healthcare sector, I have experience working with private companies, ranging from leading global pharmaceutical companies to mid-market companies, as well as the public sector, including statutory health insurance companies, and public and private hospitals. I have advised on matters of public regulatory and procurement law in relation to pharmaceutical products and medical aids.

Aside from ensuring savings in healthcare, my main goal has always been to ensure compliance and balance the interests of health insurance companies and the pharmaceutical industry, which in turn benefits the insurance holders.

In the rail transport industry, I have been involved in the landmark decision of the German Supreme Court which enabled market entry for competition from other countries on the German rail transport market. I have also developed strategies for competition-compliant participation in similar tenders. Two particular landmark cases were the Stuttgart Network and the Rhein-Ruhr-Express.

In the field of security and defence, I advise various providers in complex and commercially important procurement procedures for the allocation of military and non-military equipment as well as related services. In addition, I lead the German Defence working group.

In addition I am a regular contributor on procurement and healthcare issues and editor of the books 'Digital Health' and 'Procurement law in healthcare' ('Vergaberecht im Gesundheitswesen'). Also, I am a regular speaker on various specialist topics and a specialist lawyer for public procurement law.
Experience
  • Developed tender models for indication-based patents, blazing a trail for this development in Europe, which has been closely watched by the market and is likely to serve as a blueprint for other EU jurisdictions.
  • Implemented the Open House / Open Book model for a public sickness fund and was instrumental in defending it before the award chamber and the Higher Regional Court. This model benefits both the public sickness funds as well as the insurance holders and has been confirmed by the CJEU.
  • Developed tendering models for biosimilars (e.g. pancreatin and ciclosporin).
  • Won recognition for advice on tenders and the development of alternative tendering and price models in compliance with procurement law (such as in 2011, the 3-partner model, and in 2015, the cascade model in supply shortages). This has resulted in significant savings for public sickness funds.

  • Doctorate at the University of Münster, with a dissertation on European and Public International Law
  • Legal clerkship at the European Parliament in Brussels and Strasbourg as well as at the State Chancellery of North Rhine-Westphalia
