Bird & Bird acts for Interdigital in UK High Court patent victory

Bird & Bird’s London patent team has secured a win before the UK High Court for their client InterDigital, one of the world’s largest mobile and video technology research and development companies. On 31 January 2023, Mr Justice Mellor held that the defendant Lenovo group companies were infringing the standard essential patent in the UK and that it was valid.

InterDigital initiated legal proceedings against Lenovo in the United Kingdom (and in the US district court in 2019) after it became clear Lenovo would not willingly agree to pay for a fair, reasonable and non-discriminatory (FRAND) licence to InterDigital’s wireless patent portfolio.

This decision is the third of five technical trials between the parties. InterDigital has already succeeded before the UK Court of Appeal in the preceding two technical trials (represented in those actions by Gowling WLG) and is now awaiting the decision in the additional trial to establish FRAND licensing terms which was heard in January and February 2022.
