Katharine Stephens reports on two Court of Appeal cases involving easyGroup. One decision relates to the issues of misrepresentation and damage in easyGroup’s claim that the use of the mark "Easy Live Auction" constituted actionable passing off. In the other, the Court of Appeal reviewed issues of infringement under Sections 10(1) and (2), and considered the issue of honest concurrent use, in connection with Nuclei Ltd’s use of the mark EASYOFFICES.
