This month, we report on the High Court’s judgment in Société des Produits Nestlé S.A. v Cadbury UK Ltd* (Meade J; [2022] EWHC 1671 (Ch); 5 July 2022) regarding the requirements for registration of colour marks. We also report the High Court’s decision in DC Comics (Partnership) v Unilever Global IP Ltd* (Green J; [2022] EWHC 434 (Ch); 2 March 2022) on whether the evidence submitted to show reputation and goodwill was sufficient to meet the legal threshold.
