The Unified Patent Court (UPC) webinar series part 3, Tuesday 12 March 2024

When the UPC opened its doors for business on June 1st, 2023, no one could really predict what this would mean for patent rights holders or the lawyers representing them.

Bird & Bird’s international patent team has been present in the courts since the first week and has been compiling its learnings from day one. Join our team for the third instalment of our regular UPC update webinars, where we will take an in-depth look at the last 3 months of the UPC and what developments we can expect to see in the near future:

  • Update on cases: Preliminary objection
  • Order of the UPC Local Division Munich of 20 December 2023, UPC_CFI_ 292/2023:
    • Does the UPC consider prosecution history in claim construction?
    • What is the role of the prosecution history in claim construction according to German law and case-law?
  • Preservation of evidence (seizures)
    • Recurring and trending topics in UPC granted orders
    • How the UPC differs from some national jurisdictions (e.g. Belgium, France, Italy)

* Some of these topics may be subject to change depending on the ongoing developments happening in the UPC between now and when the webinar is scheduled to take place.
