Is there a specific enacted legislation regulating AI in your jurisdiction?

Currently, there is no specific national enacted legislation regulating AI in the Slovak Republic. The general EU AI Act is applicable.

Is there a proposed legislation regulating AI in your jurisdiction?

New Slovak AI Act is proposed. The aim of the proposal is to regulate the competences of the relevant local public authorities with respect to the relevant parts of the general EU AI Act (Chapter I - Art. 28 to 29 and Chapter VII - Art. 70 of the EU AI Act).

Ethical Guidelines for the teachers with regards to the AI usage during the teaching and education process from 2022.

Who are the competent AI supervisory authorities in your jurisdiction? 

By 2 November 2024, each EU Member State should have designated the competent public authorities which shall supervise compliance with obligations under EU law to protect fundamental rights in relation to the use of AI systems. The Slovak Republic has published and notified within the abovementioned deadline the Office for Personal Data Protection of the Slovak Republic (ÚOOÚ) and the Office of the Public Defender of Rights (VOP). It is expected that the scope of competent authorities will be extended. 

Are there any publicly known enforcement actions in relation to AI?

Judgement of the Regional Court in TrenĨín (Krajský súd v TrenĨíne) from 21 November 2024, file No.: 19CoPr/2/2024. The court has judged that although artificial intelligence is also beneficial in the justice system (e.g. speed and comparison of data), the final judgment of a case cannot rely solely on software and its algorithms, but on a judge's interpretation of legal norms and their application to a specific case.

The Slovak Bar Association proposed to adopt internal rules for associates with regards to usage of AI. In addition, the Comenius University in Bratislava adopted an internal directive on the AI usage with regards to the education process.
