Franchise regulation

The Federal Law for the Protection of Industrial Property and its regulations governs franchising.

Pre-contractual disclosure requirements

Franchisors must disclose specified information to the franchisee at least 30 days before executing franchise agreement. This information includes a description of the technical support that the franchisor will provide, the geographical area in which the franchise operates, and the seniority of the franchisor.

Franchise agreement must contain certain mandatory clauses, including geographical area of the franchise, inventory and marketing policies, supervision criteria and procedure, and the reasons for which the agreement may be terminated.
