A draft bill implementing legislation has been published on 5 February 2025 by the Federal Ministry for Economic Affairs and Climate Protection and the Federal Ministry of Digital and Transport.

The proposed maximum penalty (Bußgeld) is EUR 5,000,000 or in the case of a company, up to 4% of its annual turnover in the European Union in the previous financial year, whichever is higher (whichever is higher; these penalties may be exceeded where this is necessary to outweigh the economic benefit derived from the offence.). In addition, coercive fines (Zwangsgelder) of up to Euro 10,000,000 (these may be imposed repeatedly until compliance has been achieved).
