The Consumer Protection Act 2007 (as amended by the Consumer Rights Act 2022) (the “CPA”) implements and gives effect to the Unfair Commercial Practices Directive (“UCPD”). The primary application of this legislation pertains to B2C relationships. The blacklist of prohibited commercial practices provided under Section 55 of the CPA applies only to B2C relationships. A consumer is defined under the CPA as a “natural person (whether in the State or not) who is acting wholly or mainly for purposes unrelated to the person’s trade, business or profession”. This definition demonstrates that the law does not consider a legal entity or a business acting in a professional capacity as a consumer.
