Explanatory note re status

The United Kingdom recently announced that it had “no plans” to implement the DSM Copyright Directive. This is consistent with its position on all aspects of EU law which do not require implementation prior to the end of the transition period (December 2020). The UK was one of the more vocal proponents of the Directive, so it is likely that the government will come under heavy pressure to make similar changes from the industries which most stand to benefit. Whether it does so or not is hard to predict, as things stand. Relevant factors include whether legislative time can be made available and, perhaps more significantly, whether trade negotiations with the EU and/or the USA influence the government's thinking.
