Franck Muller’s intended use of “MARINER” as a trade mark was found to constitute an actional misrepresentation under the tort of passing off in Singapore. The decision was reached by the IP Adjudicator, and was founded on the basis of the trade mark’s similarity to, and likelihood of confusion with Rolex’s earlier “SUBMARINER” trade mark.
