I am a Dispute Resolution partner based in Hong Kong, focusing on commercial disputes and regulatory matters.

Over the years, I have worked on a number of high value commercial disputes, specialising in matters relating to complex commercial transactions, trusts, shareholder's disputes, financial institutions and estate / probate disputes.

I have acted as a trusted adviser and primary point of contact for clients in some of the most high profile dispute cases in Hong Kong, many of which involve novel questions of law, cross-border elements and tycoons' families.

I am experienced in both litigation before Courts in Hong Kong, and in international arbitration under various institutional rules (including proceedings conducted under the ICC, SIAC and HKIAC rules). My litigation expertise is not limited to monetary disputes but also extends to administrative law and judicial review proceedings against the Hong Kong SAR Government and statutory bodies.

I also act regularly for investment banks and listed companies in Hong Kong, advising directors and employees with regard to the handling and defending of investigations by Hong Kong and overseas regulatory authorities. I also frequently advise corporate clients on compliance issues, including in relation to the Securities and Futures Ordinance and the Listing Rules of the Hong Kong Stock Exchange.

  • Acting for a Hong Kong based investment fund and one of its responsible officers in challenging the constitutionality of Hong Kong Securities and Futures Commission's investigation (for suspected market manipulation) and subsequent sharing of information with the Financial Services Agency and the Securities and Exchange Surveillance Commission of Japan. Successfully obtained leave to judicially review the SFC's decision to transmit compelled evidence to the Japanese regulators.
  • Representing many listed companies and their officers in dealing with various investigations by the SFC (e.g.in relation to offences of insider dealing and disclosure of misleading information). Assisted clients in preparing for and attending SFC investigation interviews. Also assisted clients dealing with documents/ data seized by the SFC and advising on legal privilege and statutory secrecy issues.
  • Defending a non-executive independent director of a listed company in disqualification proceedings brought by the Securities and Futures Commission.
  • Representing a major Hong Kong retailer in prosecuting a claim (ICC arbitration) for outstanding payments under an asset transfer agreement against a proprietor of a renowned American clothing brand. This case involves analysis and forensic evidence on voluminous sales data.
  • Representing a Chinese sportswear manufacturer defending a claim (ICC arbitration) brought by one of its sponsored athletes who is a high profile NBA basketball player in the United States. Successfully secured a favourable settlement for the client.
