At Bird & Bird, I am a junior associate in the Administrative & Regulatory Group in our Madrid office. My practice focuses on regulatory compliance advice for technology companies, particularly in relation to the telecom and audiovisual sectors, both in Spain and Portugal.
I work in an ever-changing sector, technology companies providing innovative services, such as OTT, M2M, IoT and streaming, are developing products and/or services faster than the law can keep up. In order to operate in this market companies need as a minimum - certainty.
My role, as part of the regulatory team, consists of creating a safe path through which our clients can understand which regulatory environment they are exposed to. To achieve both compliance and risk avoidance, I match the applicable law requirements to the relevant business as well as analysing the regulatory authorities (at EU and national levels).
It not only includes the analysis of market entry conditions, but also concerns areas such as network deployments, access and interconnection agreements, conditions imposed to SMP operators, exclusive broadcasting rights, etc. In addition, although my role is to avoid penalties, my work also involves the defence of clients in sanctioning proceedings for regulatory infringements, either at administrative level or in judicial review.
I also advise on the various stages of public procurement, in both Spanish and Portuguese jurisdictions. Public procurement is an essential matter for some companies and also an innovation driver. On one side, I support contracting authorities in the drafting of tender documents, mainly in pre-commercial procurement [PCP] and public procurement of innovative solutions [PPI] procedures; on the other side, I advise companies on the analysis of tender documents, and provide support on the preparation and submission of the documentation required, as well as on the requests for administrative review of decisions adopted by contracting authorities, etc.
