Our Warsaw Real Estate team, led by Joanna Chmiel, recently advised international bakery products supplier Lantmannen Unibake Poland in connection with a greenfield project concerning a bread production facility to be located in western Poland.
The project started at the beginning of this year and involved due diligence of the property owned by a local authority, its acquisition via a public tender and obtaining a permit for land acquisition from the Ministry of Interior. It also involved signing a shell and core construction works contract for the development of the facility with the client as the employer and a well-known Scandinavian construction and infrastructure company as the contractor.
The project team comprised: Katarzyna Matusiak, who was involved in preparing the DD report together with Magdalena Nowak, and assisted Joanna Chmiel (Head of the Polish Real Estate Practice) and Pawel Lis in preparing the shell and core construction works contract.
During the project, the team solved a range of complex issues in relation to the mechanics of the FIDIC template-based construction works contract, the land acquisition permit, and the terms and conditions of the acquisition of the real estate.
