Bird & Bird helps DWP renew £500m BPO contract with Atos Origin

Another success for firm’s unique “Retender Roadtest” product

International law firm Bird & Bird has advised the Department for Work & Pensions on the retender of its medical services BPO contract - a deal which is worth £500 million over seven years and which has just been awarded to Atos Origin. Underpinning the successful retender is a product which Bird & Bird has uniquely developed to help its clients upgrade current contracts to make them suitable for retendering.

As part of the deal, Atos Origin will manage the provision of medical advice and assessments on behalf of the DWP – a service which lies at the heart of the government’s welfare reforms. This will include introducing technology and process transformation to reduce end-to-end processing times and enable better informed decisions through evidence-based medicine for Incapacity Benefit, Disability Living Allowance, Industrial Injuries Disablement Benefits, and other benefits.

The nature and scale of the two-year procurement project required a multi-dimensional Bird & Bird team with specialists across the firm’s IT, commercial, employment, real estate and finance teams. An important aspect of the team’s support for the project was the “Retender Roadtest” product which has been developed exclusively by Bird & Bird for clients going through retenders. Specifically the product is aimed at enabling clients to prepare to retender their contracts and, in the event that the incumbent is not successful, transition to a new contractor.

Hamish Sandison, the partner leading Bird & Bird’s medical services project team, explains:

“We developed our Retender Roadtest to support the many organisations in the public and private sector who are now retendering their major outsourcing contracts. It helps our clients to ensure that there is a level playing field between their existing contractor and potential replacement contractors, and a smooth transition in the event that the incumbent is replaced with a new contractor.

Commenting on Bird & Bird, Pauline Kelsall, who led DWP’s medical services team, added:

“Bird & Bird delivered a highly efficient and integrated service. Their “Retender Roadtest” is a highly effective tool which helped us to bring this significant reprocurement exercise to a very successful conclusion”.
