The highlights this month are:
European Commission publishes proposed draft e-Privacy Regulation text: The European Commission has published the proposed text for the new e-Privacy Regulation. This new Regulation, if adopted, will replace the current e-Privacy Directive and will establish, together with the GDPR, a new privacy legal framework for electronic communications.
Article 29 Working Party publishes various GDPR-focused guidance: The Article 29 Working party published guidance in December 2016 on the right to data portability, on identifying the lead supervisory authority, and on the requirement to appoint a Data Protection Officer. Analyses of the guidance are provided in this Bulletin.
Norman, R v [2016]: This Court of Appeal judgment examined the Article 10 rights of a journalistic source under the European Convention on Human Rights, which were found to be likely not engaged where a media corporation discloses the identity of their source to the police.
