Poland did subscribe to the decision on enhanced cooperation of 10 March 2011 but in the end decided not to join the system and not to ratify the UPC. Unfortunately, there have been no further discussions on Poland's participation in the UP/UPC ever after. The approach at the moment is 'wait and see'. Once the new system is up and running the decision whether to join or not may be reconsidered. However, there is a very strong opposition against joining the new system from the Polish patent attorneys' corporation and some academics and Polish businesses are afraid of patents being used by big international companies to get rid of them. Also the current political climate in Poland (protection of Polish economy, strong Euroscepticism) is not very supportive of joining the system. In his opinion of 18 November 2014 in relation to the Spanish appeals, Advocate-General Bot said that countries who have subscribed to the enhanced cooperation, but do not ratify the UPC Agreement infringe on the principle of sincere cooperation of Article 4 TEU. This may create some additional pressure for Poland to join but for the time being does not seem to have too much impact in Poland.
