A series of REMIT infringement decisions in the last quarter of 2018 shed more light on the interpretation of the prohibition on wholesale energy market manipulation. They included decisions in both wholesale gas and energy markets, by Danish, Spanish and French authorities, and covered three very different types of practice: "marking the close", sending false or misleading signals as to the demand for products and hoarding interconnector capacity.
Over 5 years after national authorities were required to start enforcing REMIT, there have been very few decisions on the market manipulation prohibition – the only previous decision was in 2016. So these decisions provide an important insight into the emerging practice of the EU energy regulators. Our webinar will provide an analysis of these new decisions and practical guidance as to the conduct of investigations. We will also touch on the consequences of Brexit for market participants in the UK.
