The law that every aviation lawyer and commercial negotiator needs to know:

  • Supreme Court guidance on interpreting contracts (the impact of Arnold v Brittan) - relevant for all in-house teams interpreting signed agreements for the business
  • Forming binding contracts: the challenges of 'commitment letters', MOUs and letters of intent (Pagnan, RTS, Barbudev, Vistajet, Alubaf - this last is the High Court decision in the aviation sector which we believe is being appealed to the Court of Appeal, but which contains valuable lessons in any circumstances)
  • Forming binding contracts and varying signed contracts: do the formalities matter and when can they be waived? (Court of Appeal decisions - Reveille, TRW, Rock Advertising)
  • The battle over 'good faith': where it applies, and where the courts are pushing back and rejecting is application (Cottonex, Globe Motors, Property Action Group)
