The Cyber Security Law in China took effect on 1 June this year. The new law contains important provisions relating to network security and data protection, and in particular, data localisation requirements and restrictions on international transfer. However, many of the provisions under the law are still unclear and further implementation measures are expected to be issued by the Chinese government to provide further guidance.

International companies doing business in China should understand the cyber security and data protection requirements and restrictions under the new law, and consider its applicability to their operations in China. We will also explore the data protection provisions under the new law in the context of the development of data protection law in China.
