The aim of this breakfast seminar is to highlight the different issues which may be relevant in a pre-litigation environment from managing any dispute resolution process to what you need to have in place when you commence proceedings should settlement discussions fail.
In this session Robert Rhoda and Grace Lee will cover:
- without prejudice in the context of settlement discussions
- settlement itself
- what to be aware of when drafting a letter of claim
- case studies to explore alternative, tort-based causes of action (including economic torts, conspiracy and breach of confidence) and
- a look at the different considerations which apply when pursuing a non-contractual claim in the Hong Kong courts (including jurisdiction/governing law issues and alternative measures of damages).
