Procurement loophole - changes to framework agreements

A recent European court decision has further expanded the area of case law which allows authorities to avoid a public procurement process, as long as they are not the deciding-body when it comes to who should be awarded the contract. The court also held that a framework agreement did not fall under the EU procurement directives. This decision could have significant consequences which may affect existing and future framework agreements.
