Jane Mutimear is a partner in Bird & Bird’s Intellectual Property department specialising in all types of intellectual property litigation. Jane, who has been called a leader in her field by Legal 500, regularly advises clients on cross-border cases, liaising with lawyers in other jurisdictions to plan a litigation or defensive strategy for international clients. Bird & Bird’s international practice means that Jane regularly works with her colleagues in other offices to bring an integrated solution to a client’s intellectual property problem. Jane has been involved in patent matters covering a wide range of technologies, including electrical/electronics (e.g. Pifco v Philips Electronics, Nokia v InterDigital, Qualcomm v Nokia), mechanical patents (e.g. JCB v Manitou, Petroline v Pressure Control Engineering), chemical (e.g. ICI v Montedison, Trespaphan v Polinas), and pharmaceutical (e.g. Astra AB (omeprazole litigation); Merrell Dow (terfenadine litigation).
Her other reported cases include Harrods v Harrodian School (passing off); Baby Dan v Brevi (design right); Kenburn Waste Management Ltd v Bergmann (contract/threats of patent infringement), Gerber Products v Gerber Foods (trade mark use), R v The Licensing Authority exp Novartis (regulatory), R v Licensing Authority exp APS (regulatory), Société des Produit Nestlé v Mars (trade mark) and Phones 4U v Phone4U.co.uk (passing off/trade mark).
Jane has lectured and written on a wide range of intellectual property issues. She remains involved with the Intellectual Property Constituency of ICANN, of which she is a past-president. She is a member of the UK Council of AIPPI and chair of AIPPI committee Q180, dealing with internet related issues. She is a member of the Pharmaceutical Trade Mark Group and a member of The Intellectual Property Lawyer’s Organisation.
