Having acted for clients before the IPEC, High Court and Court of Appeal, as well as the CJEU, Ewan has a particular focus on patent litigation, often being co-ordinated across borders. Examples of Ewan's cases include: Kenilworth FundingCo LLC v Microsoft Mobile UK Limited, Nokia GmbH v IPCom, Nokia Corp v HTC Corp (all mobile phone patent cases), Semafone Limited v Eckoh, Whitbread (call centre telephony patent), PZ Cussons v Robert McBride Ltd (handwash bottle design), ERT v Upcycle Holdings Limited (recycled plastic moulding patent), Synthon B.V. v Merz Pharma GmbH (memantine, SPC), Monster Energy Company v Gangster Energy Drink Limited (can design), Raytheon Company v Lockheed Martin Corporation (trade mark infringement & misleading advertising), and CDL Vehicle Information Services Limited v Carweb Limited (trade mark infringement & passing off).
Ewan has a particular expertise in product and packaging design and protection, and has advised high profile clients from a range of industries, including medical devices, engineering, packaging and luxury goods on the best strategies for protecting their work internationally, and the subsequent enforcement/defence of these rights. As part of this, Ewan has advised extensively on pan-European management and enforcement of trade mark and design portfolios and associated Customs enforcement strategies.
Ewan co-heads the firm's international Product Compliance & Liability group and frequently guides clients through the complex design, manufacturing, testing and labelling requirements of the relevant EU product safety directives.
Ewan has completed secondments within the commercial & regulatory team at AstraZeneca and as actin Senior Counsel within the trade marks group at Phillip Morris International (with responsibility for the Asia Pacific region).
Ewan holds a degree in Biochemistry and obtained a Postgraduate Diploma in Intellectual Property Law (Distinction) in June 2008. Having joined us as a trainee in 2004, Ewan qualified into the Intellectual Property Group in September 2006.
