Our Intellectual Property group in Madrid, led by Raúl Bercovitz (Of Counsel), has recently represented Mediapro, a multimedia communications group.
The team was successful in obtaining a favourable ruling made by section 28 of the Madrid Provincial Court which dismissed in its entirety the appeal brought by the managers of rojadirecta against the decision by the Madrid Commercial Court to apply precautionary measures against the website from making links available to broadcasts of football matches.
Raúl commented: "This Court ruling is especially relevant because it throws some light on a particularly burning issue, especially considering that a preliminary ruling is still pending on a matter at the EU Court of Justice also dealing with the concept of “public communication” in the case of links pages (the Sanoma case) which will be ruled upon in the second half of this year."
