Data Protection Update - September/October 2014

We are pleased to provide our latest data protection update of news and developments in September.

Key points to note:

  • A new Court of Appeal(NI) case that suggests an award of a nominal damage of £1 for breach could lead to successful compensation claims for distress
  • A new CJEU case may affect controllers' approach to subject access requests;
  • The Article 29 Working Party has issued an opinion on the Internet of Things, including wearable technology; and
  • An individual was prosecuted recently under s 55 of the Data Protection Act 1998 for taking precedents and work-lists (containing the personal data of others) from his employer when leaving for a new job.
