Slovak Republic: Amendment to the foodstuffs regulation

The bill to the Slovak Act No. 152/1995 Coll. on Foodstuffs (hereinafter referred to as the Bill) was amended and proposed by the Ministry of Agriculture and Rural Development of the Slovak Republic and approved by the Government of the Slovak Republic as of 05 November 2013.

For the purposes of introduction and implementation of the measures aiming at (i) the facilitation of enforcement of data provision on the percentage share of sold foodstuffs produced in the territory of the Slovak Republic as well as (ii) the facilitation of publication of the list of sellers having this percentage share, the Ministry of Agriculture and Rural Development of the Slovak Republic has proposed the Bill that shall positively affect the information flow to individuals and the business environment. Furthermore it shall reduce the administrative expenses of the certain individuals in this respect.

The Bill shall in particular promote as well as advertise the local foodstuffs and agricultural products (the regional and farm foodstuffs and agricultural products included) by designating and highlighting them with the information e.g. " Slovak foodstuff/ Slovak agricultural product" or " foodstuff/ agricultural product produced in the territory of the Slovak Republic."

In the light of Article I of the Bill, foodstuffs and agricultural goods that are produced in the territory of the Slovak Republic and placed on the Slovak market may be voluntarily designated with data specifying the consistence as well as the country of origin etc. The particulars thereto shall be specified within the general binding legal regulation adopted by the Ministry of Agriculture and Rural Development of the Slovak Republic.

In addition, the Bill amends obligations of sellers with certain annual turnover (i) to deliver to the Ministry of Agriculture and Rural Development of the Slovak Republic as well as (ii) to publish on their official websites, the report determining the percentage share of the sold foodstuffs produced in the territory of the Slovak Republic from the total amount of all foodstuffs sold etc.

The Bill was delivered to the Slovak Parliament on 06 November 2013 and after approval, it shall become effective as of 01 March 2014.
