China: Increased penalties for copyright infringement

On January 30th, China’s State Council issued notices announcing the latest round of amendments to the Regulations for the Protection of Computer Software, the Implementing Regulations for the Copyright Law and the Regulations on the Protection of Right of Dissemination via Information Network, all with effect from March 1st.

The amendments set higher standards for calculating penalties for copyright infringement, if the illegal revenues exceed RMB 50,000, the penalty will range between one to five times the amount of the illegal revenues; if there are no illegal revenues or the illegal revenues are below RMB 50,000, a penalty of up to RMB 250,000 may be imposed based on the severity of the circumstances.
