Paris Court rules on use of image rights in commercial advertising

In two recent case, the Paris Court has given useful guidance on the use of images in commercial advertising. In the first case, a model was hired to shoot an advertising video for an IT start-up company. An agreement was signed giving the company permission to use the model's image for two years, but the image was still available (with the model's face blurred) on the company's website beyond the specified period. The Court held that blurring the model's face was not sufficient to avoid image rights infringement. In the second case, a model for the same company was hired as a communication assistant but carried on modelling. There was no agreement for the use of the model's image rights and the model's image was used extensively on multiple media accounts. The Court ruled that taking part in photo shoots did not imply consent for the model's image to be used on multiple media platforms.
