Domain name held to be a property right that can be subject to forfeiture, Swedish Supreme Court rules

In December 2017, the Swedish Supreme Court ruled that a domain amounts as a property right due to having more than just economic value and that the domain name could be subject to forfeiture because it was being used an instrument of crime. This decision follows a recent report by The Internet Foundation which found that 75% of Swedish 16-25 year olds use pirate streaming sites, raising difficult questions over whether a domain can be subject to the same forfeiture rights as other property under the Swedish Copyright Act. This court decision held that domains can be treated as property, despite a domain not having a physical nature.
