Fidel obtained his Law Degree in 1998 at the Complutense University of Madrid and spent his last year at the Universitá degli Studi di Bologna, Italy. He holds an Advanced Studies Diploma of Law (Commercial Law Department of the Complutense of University of Madrid) and was a Visiting Researcher at the Juristen Fakultät, Universität Leipzig, Germany and a Complutense Fellow at the European Law Research Center (Harvard University, U.S.A.).
Fidel has represented and counselled both national and international clients before the Spanish Courts and the Spanish Trademark and Patent Office in the area of Intellectual Property including litigation, prosecution, negotiation, licensing and administration of intellectual property assets.
In particular, Fidel is a chartered Trademark Agent who has represented mayor players in advising and managing worldwide brand portfolios in varied market sectors: medical devices, hoteliers, food industry, publishing, banking, electronics and sports. He is leading the Brand Portfolio Management Services offered by the Madrid office.
As a litigator, Fidel has experience in administrative Courts and Supreme Court (including General Court of EU) in relation to trademark appeals and has represented clients in the previous firm in civil litigation matters related to nullity and infringement of trademarks and patents as well as pharmaceutical liability.
He is also involved in anti-counterfeiting issues. During the past two years, he has coordinated a Spanish team for a major manufacturer of electronic products in relation to the application for customs action in Spain (in total more than 300 hundred seizure cases with hundreds of thousands of devices).
Fidel has authored several articles published in magazines specialized in patent law (“Written opinion about the State-of-theArt report”), trademark law (in relation i.a. to generic medicines branding), copyrights (analysis of the law 3/2008 of 23rd of December regarding the entitlement to share in the profits of the author of an original work of art) and the responsibility of Internet service providers (General Court cases C-236 to 238/08 Google vs Louis Vuitton and the ruling of the Criminal Court Number 1 of Logroño regarding file sharing). Fidel has also participated in roundtables regarding, i.a. Supplementary Certificates of Protection and legal aspects of the responsibility and the traceability of medicines and commercial contracts. Finally, Fidel has authored the last edition (2011) of the Life Sciences Getting the Deal Through relating to the Spanish jurisdiction, and has co-authored the Spanish chapter of a book on law of computer and video games to be published in Germany by Erich Schmidt Verlag GmbH & Co. KG. Fidel is editing member of The Trademark Reporter, a New York located magazine specialized in Intellectual Property.
